Are you having it pull the same sims in over and over? (not intentionally) I've been downloading practice sessions of 5 sims using all topics. It keeps giving me the same ones mixed with new. I sortof wish it didn't do that, but it does force me to do them til I get them.
I saw Wiley was down tomorrow so downloaded 5 sets of 10 sims. I'm hoping to get through all 40. (There are 40 total in Wiley, I think?)

InactiveI have to take REG on 5/31. Completed one review of business law and two chapters in taxation. Taking the last week of May off for studying. Do you think I should reschedule to July or can I make it? I started studying from May 3rd and have been putting close to 3 hours hour daily.So confused now..ugh

I just got an EXTREMELY frustrating contract question in WTB. Cont-0056.
Assuming all requirements are met, which terms must be included in writing to satisfy statute of fraud for goods?

Time of payment
I chose Quantity only. Because price and timing aren't required. But the correct answer to click on was Price and Quantity… how is this you ask???? Here's the explanation (spoiler alert) it makes no sense. Please explain this to me if you get it and I'm just dense today, lol.
“In order to satisfy the UCC Statute of Frauds regarding the sale of goods, the quantity term must be included in the writing. Failure to include the time of payment will not cause the writing to fail to satisfy the UCC Statute of Frauds because a reasonable time of payment will be inferred. Failure to include other terms of the contract, including price, will not result in an insufficient writing either. The Code implies that the parties will in “good faith” determine a resonable [sic] price”

It used to be that both price & quantity had to be specified but that's not the case any longer. And, funny thing, that's what the quoted answer says exactly. Omission of all terms but quantity will NOT result in insufficient writing (under the Statute of Frauds).
Chalk it up to the error; I have found several like that in Becker's FAR part and had sent them email (it had been updated recently).

I'm wondering if anyone has any advice for credits. I know Jeff said there were certain ones he recommended memorizing, but I don't remember what he said. (I really gotta stop sleeping through the audio!)
Any trick or advice on memorizing those and which ones to focus on?

From what I've seen between Yaeger review and the Ninja notes, much of the focus has been on the educational credits, dependent credits, and foreign tax credits. It's not fantastic, but a mnemonic for this could be DECALF. The EIC, Additional CTC, and AOC are all refundable, under different circumstances. I hope this helps.

The Becker final exams are disheartening. Some I genuinely do not know and others are just stupid mistakes. I hope so much I don't make stupid mistakes on exam day. I got 67% but at least 7 of the missed were stupid mistakes on the multiple choice. (I know they don't count each equally, I do though for my calculation.)
The sims were really hard this time. I hope that better prepared me. I know how to do them, but oversimplified it and made mistakes. (On top of that, I was so tired of it that I took a break to watch tv in the middle and almost ran out of time at the end, so rushed through them.)
Getting burned out…Someone send me some CPA mojo!

Member@MCKLT, the way i learned to distinguish between “real” vs. “personal” defenses is to think of which acts would REALLY get one in a big-time trouble :), i.e. serious stuff that will preclude hdc from collecting.
Becker has “FAIDS” x 2 mnemonic for real defenses:
F, F – fraud in execution; forgery of signature (note: signature is forged, NOT a mere unauthorized completion with valid signature);
A, A – adjudicated insanity (and contract could not have been legally signed in the first place); material alteration;
I, I – infancy (minority of the maker); illegality (check is a pmt for an illegal act);
D, D – extreme duress (gun to head, not just threating); discharge in bankruptcy known to holder in due course;
S, S – statute of limitations has expired; suretyship defenses known to holder;
Most all other issues are personal defenses that are minor if compared to the ones above. Any time some contractual duties are breached, fraud in inducement, mistakes, unauthorized completion (filling in of blank lines that maker carelessly left as such and tempted others) are personal defenses and they can not be raised against the hdc and he will get paid.
