bwt, I just viewed Peter's explanation for that page and sure enough, he does try to drill down that “Gov. only”. Perhaps he meant that only government may ask for: divestiture, injunction, dissolution or cease & desist orders. Well, if that what he meant, then it is a true statement. And, individuals may ask only for triple damages (treble) and attorneys' fees. Both can sue but for different things.

A partnership creates a fiduciary relationship between partners because being a partner means you are an agent for both the partnership & for the partners.

Partnership law draws heavily on agency law because each partner is an agent and also a principal.

I recommend doing the free questions online from the cpareview for free – and if you want – also buying the $10 of sims.

I also recommend going through the aicpa released tests – older and newer.

and finally – anything you find difficult & challenging – restudying that

SeattleAccountant. Thanks, what gets me is that on page R8-61 Peter circles Private Action and says it is unique to Sherman. I guess he could be saying a “civil suit” by a private party is unique to Sherman and reiterates that on page 64. As for private parties under Robinson-Patman they can only sue for damages but not bring a civil suit…I know im being very anal about this, but when I took BEC i had a question where I was unclear due to Becker's explanations and got it wrong..

Ok, got my hands on a 5 hour energy. Whee! I should have done this weeks ago!

Finished chapter 6, including notes, going to do a progress test now. I need to have all chapters done by next weekend so I'll have two weeks for review. I'd have liked to have longer, perhaps I can get the chapters done sooner…not sure yet.

This is my 2nd attempt at the exam, I had two parts passed (failed many) and I stupidly quit, big mistake. Now I'm back and with a vengeance!

Just took the SOB…I think that the MCQs went really well and I felt that the testlets got progressively harder (that's a good sign). BUTTTTTTT the Sims really beat me up and I got a research question that I could not find. Nothing I can do now but pray for a 75! On to FAR in July.
