LSNYCMemberI agree final exams can hurt people's confidence unnecessarily, I try not to take any ‘exams' before my actual exam.
An hour and a half in to my 6 hours day of studying! Starting to get some good results hoping it is not memorization of the questions…..

wendywhiteMembertook today off. been studying since 7. 1 hr for lunch/shower. 6 hour mark here as well and I am FALLING ASLEEP – but making progress.

I wish someone would invent a sitcom that slips in things I need to know for the test. I'd much rather learn that way.

I'm on final chapter R-8 of review.
Now, the fear of failure kicks in b/c i'm realizing that the earlier (taxation) chapters are so vague in my memory 🙁
Hopefully, a second look at them will take care of this issue but I better shape up in terms of quality time devoted to REG. Count down begins next week, no more excuses or looking back!

AnonymousInactiveAre LLP partners agents of the partnership and do they owe fiduciary duty to the the partnership and each other? I'm a little bit confused on this point. The differences that Becker lists on a single page (2013 page R8-17) does not clearly state that they are not agents…I tried googling but did not find anything. Thanks

I really need an advice from those of you who took REG already… I had a plan to study full time for 6 weeks but got sick and lost two weeks plus my graduation is coming up which means i'm losing another week of studying because of family in town… would I be able to study from May 13 and take the exam May 30? that pretty much gives me barely 3 weeks although I can definitely study 8-10 hours a day…. or i can just postpone it to July 1st and study all of june… I really wanted to get it over with but not sure it's doable anymore… suggestions?

AnonymousInactiveI have a question for anybody who has Becker. In the book it says that when contributing towards forming a corporation, the taxpayer's stock basis is:
Old Basis
Less: Boot
Add: Recognized Gain
New Basis
However, in question 2, Sim 1 for R3, Jones's basis is not increased by his 10,000 recognized gain. Does anyone know why this does not increase his basis?

lauryateMember@Jimmy520 – If the gift tax raise is for 2013, I don't believe they'll update the exam with that amount this year. Also, from what I've seen on the Becker questions, they usually will say “assume the exemption amount is XXX”.
Pushing my exam back 2 weeks because I'm out in California for work. I'm not getting many MCQs done, and I really don't want to studying all weekend when I could be out in the sun!

Question after tomorrow (I think) ill have done all of the Wiley questions 3 times…. Anything you guys recommend for me to do the final days before my exam?

AnonymousInactiveHi, Can someone with Becker please help. On page R8-64 of the Antitrust Law section Peter Olinto clearly states that enforcement of Clayton and Robinson-Patman is civil only AND “Government Only”, the government only part is even written down in red. This makes no sense what so ever considering on the very next page it states private parties can sue for treble damages as well. Is this a dumb mistake by Becker or are my missing something?

In US, for antitrust violations under Robinson-Patman Act (an amendment to Clayton Act) both the US government and the injured party may bring an action. Basically, anyone injured by an antitrust violation can sue for damages. This is in contrast to many other countries that permit ONLY government but not private parties to sue for the antitrust.
Perhaps you have misunderstood Becker text. It lists who can bring actions as item #1 (p. 64) Government and item #2 (p. 65) Private parties injured. So, it is both.
For Robinson-Patman/Clayton – anyone can sue but only thru civil action b/c wrongdoings under these acts are not crimes but rather violations.
vs.
For Sherman Act – anyone can sue and it could be criminal and/or civil b/c Sherman Act is concerned with serious issues that have significant impact on interstate commerce and treated as crimes.
