MikaParticipantI noticed that all of us (not all but most of us) are confused with organizational cost, I would like to share and please correct me if I am wrong.
Three scenario:
a) If organisational cost is lower then $5,000 –> Amount / 180 months
b) If organisational cost is higher than $5,000 but lower than $55,000, see example 1
c) If organisational cost is higher than $55,000, same as scenario a) see example 2
Example 1
Brown Corp., a calendar-year taxpayer, was organized and actively began operations on July 1, 2014, and incurred the following costs during 2014:
Legal fees to obtain corporate charter $45,000
State incorporation fees 5,000
Temporary director expenses 2,000
Commission paid to underwriter 25,000
Other stock issue costs 10,000
Brown elects to deduct its organizational costs. In 2014, what is the maximum amount of organizational costs that Brown can deduct?
The organizational expense deduction for 2014 will be:
Legal fees to obtain corporate charter $45,000
State incorporation fees 5,000
Temporary director expenses 2,000
Total $52,000
Since total costs are $2,000 greater than $50,000, the $5,000 portion of the deduction is reduced by $2,000 and the balance of the costs are capitalized and amortized over 180 months.
($5,000 – 2,000) + (($52,000 – 3,000) × (6 ÷ 180)) = $4,633
Example 3
Brand New, Inc., was organized and began active business on January 2, 2014. Brand New incurred the following expenses in connection with creating the business:
State incorporation fees $ 5,000
Legal fees for drafting the charter 35,000
Printing costs for stock certificates 10,000
Professional fees for issuance of stock 15,000
Broker's commission on sale of stock 25,000
Expense for the temporary directors 20,000
Total $110,000
What is the maximum amount of organization expense that Brand New may deduct on its 2014 tax return?
Expenses of temporary directors $20,000
Fees paid to a state for incorporation 5,000
Accounting and legal fees incident to organization 35,000
Total $60,000
Total organization expense is over $55,000, so the entire amount must be capitalized and amortized over 180 months.
$60,000 × (12 ÷ 180) = $4,000

MikaParticipant@ kickass, political contribution do NOT count towards your gift tax (i.e. you are allowed to give as much as you can). However, don't confuse with exempt organization regarding “politics”, if an exempt organization participate in political event, it will lost the tax exempt status.

I am doing MCQ's mostly, reviewing the book where I KNOW I need to (both AMT's, some of the new material/”misc” stuff), flash cards, and sims.
I ended up pushing my exam back to 1/17 – spent the last 2 weeks battling the flu (myself) and double ear infection/pneumonia (my son), so I haven't been able to study really at all.
I am hitting Corp/Individual tax hard and Property transactions. That's where I'm focusing most of my review, as the BLAW stuff seems to have stayed in my brain a lot more from the last time I passed REG, so I'm not too worried about those.
I'd say really look at your SIMS when you review. The first time I took REG and failed, the Sims really killed me.

The_AmYamMemberI thought they were bad the 1st time I sat and it was easier the 2nd time knowing what to expect. You could have anything from filling out tax forms to ones that are exactly like the Becker/Wiley SIMS. I don't want to violate the rules of the forum here but I would say that the Becker SIMS are what you can expect in real life. You will do yourself a HUGE favor just by doing all the practice SIMS you can get your hands on.
As far as topics to study, I will say in my final review I am really hitting these areas hard based on my experience:
Corporate Tax – specificially pages R3-31 thru 39. Know R31.
Individual Tax – the AMT sections, credits
Property Transactions: like kind exchanges, distributions (current/accumulated E+P, return of capital, etc)
I find the 3 areas above to be the most technically challenging on exam day. Remember in the SIMS you can use the research tool to assist but I only do that at the end to double check or for ones I'm really lost on.
I am staggering my review to the topics above with “breaks” to hit MCQ's for the business law pieces. It seems to help break up my study time and keep things rolling.
Once I've really hit the major topics hard with some blaw review, I go back and do a practice exam in Wiley. Or I do a study session with a 30 question set with all of the categories checked. (One thing I like about Wiley vs. Becker: it is easier to review what you want to focus on.)
I'd say you need to know everything in the book… but that is a lame answer. So this is my study plan for the next few weeks and hopefully I can come back and tell you all I passed it again.
Studying/Sitting for it a 3rd time really blows!!

Both of these items (the uniform worn while performing charitable services and the meals and lodging while on the weekend trips performing the charitable services) are deductible as charitable contributions.
Why $300 from meals can be deduct as charity? The individual need to eat anyway, just like business trip/moving expenses…
