Received this email from NY State Board –
” I write in response to your recent e-mail regarding an extension of the time you have available to pass the CPA exam.
Section 70.3(c) of the Regulations of the Commissioner requires an applicant who passed a section of the exam under the computer based test to pass the remaining sections of the examination within an 18 month period in order to be given credit for having passed the exam. The State Board for Public Accountancy or the State Education Department do not have the authority to extend the amount of time an applicant has available to pass the CPA exam. All applicants for licensure do, however, have the opportunity to petition the Board of Regents for a waiver of a particular requirement for licensure. In your case, you would be looking for a waiver of the requirement that the 4 sections of the exam be passed within 18 months. The Committee is empowered to recommend to the Board of Regents that the specific section of the licensing regulation be waived for that particular applicant.
However, the Board of Regents will accept a petition from the Committee, ONLY if it can be shown that the requirement has been substantially met. To substantially meet the examination requirement you need to have standing passing scores on all four sections of the exam, albeit outside of the 18 month conditioning requirement. Therefore, at this time you are not able to submit your petition to the Committee on the Professions until you pass all fours sections of the exam.
Historically, the Board of Regents has approved waiver petitions in those cases where an applicant has made a good faith effort to pass all 4 sections of the exam within an 18 months period, but was prevented from effectively preparing or sitting for sections of the exam by extenuating circumstances that were not generally experienced by the other applicants for licensure and that were beyond the applicant's control.
Generally, the Board of Regents has accepted the following types of circumstances as a reasonable basis for approving waiver petition: medical conditions experienced by the applicant or a close family member; the applicant's being called into active military duty; a death in the applicant's family; hardware or software failure at the testing site; unexpected closure of the applicant's testing site due to inclement weather. In regards to the late release of the Q2 – 2017 exam scores, there is no extension automatically provided. However, the late release of the exam scores may be considered as a basis of a petition, dependent upon the circumstances and facts the applicant presents. Each applicant’s case will need to be reviewed in totality, including their entire testing history.
Please be advised, the Board of Regents does not accept heavy work schedule, reassignment; or personal choices to relocate, change jobs, change life status as a reasonable basis to approve a waiver petition.
Please realize that if you have experienced circumstances that provide a reasonable basis for a waiver, you will be required to provide substantiating documentation in the form of corroborating letters from physician(s), copies of military call up papers, copies of death notices, and or correspondence from the Exam administrator (CPAES) or the testing site (Prometric).
If you did not experience any extenuating circumstances, a petition cannot be brought forth as there is no reasonable basis for a waiver. Please do not hesitate to contact the board office by e-mail with further information about your situation or if you would like additional guidance.”
