Hello everyone. I never heard about this kind of thing before. I took my FAR test on January 20 and find out on February 4 that I failed with 67. Today I received an email from NASBA coorditor that they receive a report from testing facility that during my break I accessed to my phone which was violation of exam policy. First of all I knew that policies very well and I never take brakes during my tests. It works well for me and helps staying focused. I replied to received email and with my concern that I didn’t take any breaks during test, I call that person and left a voicemail, but nobody call me back or respond to my email. Does anyone know what else can I do to get this issue reviewed. When I finished my test and sign out papers, they didn’t shown any breaks. I’m very appreciate for any advice.

candidatecare@nasba.org They have cameras everywhere in the prometric center, if you didn't access your phone you have nothing to worry about, if you did thats another story.

Thanks for reply, I will send them email as well . I didn’t even take that brake, so really don’t understand how this issue arises.

Update. Receive reply from NASBA that they will not conduct investigation regarding this issue and don’t take any disciplinary action on me. Is this real? I didn’t do any violations, didn’t take break at all and they don’t want investigate this issue. They missrepresent information about me and don’t want to take care of it. Are there any other way to address this issue ? What I had faced is very unprofessional, I’m disappointed .

Seek legal advise/remedies to clear name and set the records straight. This is my 2 cents.

I don't think they care to investigate further because you failed.
It was probably sending the email to the wrong person to begin with. I would not invest any more time into this than you already have. Mistakes happen. No harm no foul.

So, just to clarify you didn't leave your seat for the 4 hours? If you didn't sign in/out then there should be no issue. Send an email to this respect and ask for any evidence they think they have. It seems like if you didn't leave the computer and obviously didn't have your phone in your pocket this is an open and shut case?

I Re-read, if there is no further action and you're not prohibited from taking more exams then ignore it. Don't poke the bear! Just carry on studying and get a 75, that's the best revenge!

If they had admitted an error in the email then there is no need to purse further the matter. But if is just” will not conduct investigation regarding this issue” then still my 2 cents is to seek legal advise. As CPAs we got to protect our credibility and integrity. Anyway the decision is yours.

Thanks everyone for advice. The problem that they didn’t eliminate this issue from my record and I’m care about it. I don’t want to face some issues in the future when I will apply for license. I send all emails to attorney for review and would like to submit official request to candidate care to eliminate this issue from my record. It’s unprofessional leave it unresolved. I’m understanding that anybody can make a mistake, but it should be corrected. It’s not my fault that someone make false report on me. I passed 3 sections EA and REG last year, but failed FAR this time, so I’m familiar with rules and just find out that breaks didn’t work for me. So I did all testlets one by one without interruptions.

i think you are making more out of this then needed. i concur with recked. i dont see how this impacts anything you are doing going forward. if i were you id focus my limited time on studying as much as possible and give this 0% of your brain power going forward.

Don't throw your money away on an attorney for something that is already resolved. Spend you energy studying for the retake.

Update. I sent a request to candidate care to investigate this issue a week ago . Today I received reply that investigation is complete ,Prometric made a mistake and apologize for the mix-up. NASBA will make updated report to my State Board about this issue. Thanks everyone for your opinions and support

Yea, NASBA does not have cameras at Prometric testing facilities. Prometric has cameras in their facilities and they report information to the appropriate party regarding the exam they are taking so if someone is taking the Nursing Exam, they would contact the exam administrator for the nursing exam and let them know of the issue. Since it was the CPA Exam, they sent an email to the CPA Exam Security Team, which is why you got the email from NASBA. But, yea it looks like they took care of you after following up with the issue.
