Can a DUI keep you from getting licensed?

    This is something that has been bothering me since I started the exam process. I made a huge mistake (just over 5 years ago now) and I am so remorseful for what happened. I pled no contest to DUI charges and completed all of the court sanctions. When I applied to start the CPA exam process, I was within the 5 year window so I answered “yes” for being convicted of a crime and submitted my case number and a letter explaining the situation. About a month ago, I thought about looking into getting my record expunged and I called the court about my case. I was convicted in California, now live in Kentucky. It seems that the court did not receive some of the documentation of the community service that I performed 5 years ago, and I can’t find my copy. I also can’t resolve this within appearing physically in court, which is not an option for now as I live so far away. This means my case is still open, and I am terrified that I will get through this exam process and be turned down for a license.

    Has anyone ever had anything like this before? If they decide to deny someone a license, is the person allowed to petition or respond?

    I had a DWI, but was still able to get licensed. On the NASBA application, I included any documentation I could find. It took what seemed like forever, but I got my NTS. On the state application after I passed all sections, it also asked about crimes and other acts discreditable, so I included an explanation with that as well. Bottom line, be honest about it, and they will (most likely) approve everything, especially since it isn't a financial crime.

    You probably are okay. A surprisingly large number of people have DUIs. But you should really try to resolve the open case status anyway. As that could hurt you in job searches or even if you ever (hopefully not) have any future run ins with the law.

    Sent in Application 3/12/15.
    Issued License 3/20/15.
    Used CPA Excel solely for all exams.

    Thank you both so much for the feedback! I have been so stressed about this, it's good to know that there's hope. I will be sure to just be 100% open about it and hope they understand. I am going to resolve the fact that it's open as soon as I can make it out to California. I joined a CPA firm in January and it didn't seem to be an issue, but I want it closed and expunged as soon as possible. I will do everything in my power not have run ins with the law! One is more than enough for me 😉

    Roger in his CPA review material mentions that even though they ask if you have a felony on your record, which DUI often is, they are not worried about DUIs. But you still have to tell them about it.

    Depends on state and who is reviewing your application. If it is denied, apply under another state.

    Don't worry about it that will cause you more stress than the crime actually will..

    I got in trouble a couple times over 3-5 years ago and have a deferred adjunction(still must list dismissed charges in CA) and an infraction ticket.. I will list both and am not scared at all.. One of the reasons I got a deferred adjunction instead of a real charge is because I have an awesome lawyer… who see's CPAs, Lawyers, Doctors, and Politicians with DWI's all the time.. don't stress, it's not til your 3rd one that you really have a problem.. just disclose everything and don't let anyone judge you over the internet
