    Here's another one…

    For which of the contracts will a court generally grant the remedy of specific performance..

    A. A contract of employment

    B. A contract for the sale of fungible goods

    C. A contract for sale of patent.

    D. A contract for sale of stock that is traded on National stock exchange…

    If we all are weak at same thing…let's ask questions that we think are challenging and the answer will imprint in our minds…we won't forget at the exam…

    I had trouble with this one:

    On July 1, Silk, Inc. sent Blue a telegram offering to sell Blue a building for $80,000. In the telegram, Silk stated that it would give Blue 30 days to accept the offer. On July 15, Blue sent Silk a telegram that included the following statement: “The price for your building seems too high.     What Blue sent on July 15 was an inquiry. It was not a counter offer. Had Blue said … I will accept to buy the building for 75,000.00 that would have been a counter offer and it have annulled the initial offer Silk made.

    Since Blue he said “would you consider”.. that is more a question than stating he will buy it for 75,000.

    I had a similar question like this and got it wrong when I said it was a counter offer and now realized its not considered a counter offer.

    I don't think A is right because Blue didn't accept the offer on July 1st. So I think its B – Win.
