Same here! I want to knock out my FAR retake by 11/30 that's why I really wanted to do reg 10/19 so I would have 6 weeks to restudy. I guess we'll see what happens!

Someone please help me with Secured Transactions – I really feel like a daft person here. :-

Roth and Dixon both claim a security interest in the same collateral. Roth’s security interest attached on January 1, and it was perfected by filing on March 1. Dixon’s security interest attached on February 1, and it was perfected on April 1 by taking possession of the collateral. Which of the following statements is true?

    A. Dixon’s security interest has priority because Dixon is in possession of the collateral.

    B. Roth’s security interest has priority because Roth perfected before Dixon perfected.

    C. Dixon’s security interest has priority because Dixon’s interest attached before Roth’s interest was perfected.

    D. Roth’s security interest has priority because Roth’s security interest attached before Dixon’s security interest attached.

Does anyone have an easy way to assess which is more important – to Attached first or to Perfect first. I keep seeing questions and going on a merry go round.

    @iy247

i was like i've never seen this name before, but cool

    then i recognized your avatar.

B should be right, bc if both parties have perfected, whoever perfects first has priority.

perfection has greater weight in terms of priority, and thats if the security interest has attached.

question for you: on page 50 of ninja notes, it says “no G/L if donor basis<sales price<FMV @ Gift date”

should it say, “no G/L if donor basis<sales price<FMV @ Gift date ( assuming FMV lower)

then on page 56, in property transactions, it says “sold in between donor's basis and FMV” no G/L which is correct.

Yes B is right.. so its more important to see who Perfected rather than who attached first ?

I have to look at my Ninja notes – Just now my brain is having a migraine with secured transaction LOL.

Yes I removed my real name and put my initials instead.

Which of the following is a false statement concerning priority under UCC Article 9?

    A. A lien arising by operation of law subsequent to the perfection of any security interest will be subordinate to the earlier perfected security interest because of the first-in-time, first-in-priority rule.

    B. A purchase money security interest in collateral other than inventory or livestock prevails over a prior perfected security interest if the purchase money security interest is perfected when the debtor takes possession or within 20 days afterward.

    C. A secured party with a security interest in fixtures has priority over any earlier recorded real estate interest if the interest is a purchase money security interest perfected by fixture filing within 20 days after the goods become fixtures.

    D. A perfected purchase money security interest in inventory has priority over an earlier filed security interest in the same collateral if (1) the interest is perfected when the debtor receives possession and (2) the secured party sends an authenticated notice to any prior secured party before the debtor receives the inventory.
