    @future I'm using becker lectures and MCQ. I haven't used the books or simulations for any of the tests. I've found that on the simulations one can ‘cheat' by using the authoritative literature to help get the answers

    @dilemma, I think it is 7.5, 10% starts when the new laws come in place in 2014 i think

    Changes took Place July 2013.

    Skrier is correct exam will use new rates – Study materials are using the old rates.

    Please got to your CPA review provide and down load the new changes.

    Long Corp. entered into agreements with its retailers whereby they agreed not to sell Long batteries beneath the minimum prices determined by Long. The agreement did not preclude the retailers from selling competing brands of batteries. The agreement is

    A. An exception to the price-fixing provision of the Sherman Act.

    B. Legal if the batteries are sold under Long’s exclusive trademark.

    C. Illegal per se.

    D. Legal because the retailers are permitted to sell the competing brands at any price they choose.

    @insiyah – thanks for clearing up the gross income q! i can sleep at night again

    at first i thought the answer was B, if patents have the same rights as a trademark. they're trying to max profits w/ a superior product.

    but i could see how its also D, bc it is stating something that the retailers can legally do.

    is this from wiley??

    @insiyah – my understanding is patent holder may stell the item at whatever price it desires w/out violating the sherman act. but there was no mention of a patent in the question.

    are patents have similar rights to trademarks?

    would love to see the explanation for this.

    Answer (A) is correct.

    According to a decision of the Supreme Court in 2007, an agreement between a manufacturer and its retailers establishing minimum prices is evaluated under the rule of reason. It is not illegal per se under antitrust law. Resale price maintenance, whether of maximum or minimum prices, is a form of vertical price fixing (as opposed to horizontal price fixing by competitors). It may be struck down only if an extensive economic analysis indicates that the anticompetitive effects outweigh the procompetitive effects.
