    @insiyah. The answer to my question is D.

    @mehwish… the 2013 numbers are 500,000 and phase out begins @ 2m.. I'm not sure if they applied that to 2012 as well. Maybe jeff can enlighten us, I've seen him comment on it in another thread.

    Mehwish – Ninja notes are correct as they are updated for exams taken after July 2013 .

    Sc 179 – 500,000 Phase out at 2M

    @skrier, it's 55,000… Why is it not limited to the 25,000 “mom and pop” rule?

    So you do take Capital Gains into consideration ??? Hmmmpfh… so is it only capital Gains that you can add to your basis ? I assume that non of the other ones apply.

    @UCMCPA….the Mom and Pop rule only applies to passive activity rental activities. For a partnership one who materially participates does not constitute a passive activity. Does this make sense?

    I should have added….real estate activities other than a real estate professional are always considered passive activities. The Mom and pop rule is for anyone who actively manages say a rental property for example.
