    @mama been there done that! Good job on the nice scores 🙂 I was pretty tired last night (or early morning) and managed to score a 70% on my business structures session (first time through). It was pretty shocking. I guess I must have remembered a lot of it from my BEC battles. I was also happy that I was persistent and did not go to bed until I had met my goal for the day. Today I finally begin working those tough tax questions. God help me!

    @yassy I would sit for the exam if I was scoring 70s, especially if you have a couple more days to try to raise some of them. But that's just me. Do what makes you comfortable. Where were you at with your other exams when you passed them?

    I'm west coast time so I will never be able to participate in the study sessions live. Still…just reading and reviewing answers and explanations is a huge plus! Let's get those questions rolling again!

    @jfernandes–We just post questions on here and let people give an answer then we say what the answer was. If anyone has trouble with the material they ask questions and we try to help each other. You can see how we did it by going to the Q2 FAR Study group thread. It was really helpful to me for FAR.

    Do depreciation recapture rules ALWAYS apply to section 1231 ,1245, and 1250 assets??

    Do you guys think we should be memorizing the gross estate deductions, and if so, anyone have a mnemonic?

    @Ima_Audit_You I think depreciation recapture refers to treating a portion of the gain as ordinary gain vs. capital gain.

    Sec 1245 (personal property) gain: treat as ordinary income to extent of all accumulated depreciation, remaining gain = 1231 gain (capital gain)

    Sec 1250 (real property): accelerated depreciation in excess of straight-line depreciation is “recaptured” as ordinary income, remaining gain = 1231 gain (capital gain)

    To answer your question, the “depreciation recapture” term applies always to Sec 1245 gains but not to Sec 1250 gains. Sec 1250 gains may not have a recapture in the later years when accelerated depreciation may be less than straight-line.

    1231 gain just means that the remaining gain (not taxed as ordinary gain) is treated as a capital gain, so your question doesn't apply to this.

    @Amay I recall a few questions regarding the gross estate deductions from the Ninja MCQs. Therefore, I would make sure to know them or at least have a general idea what they are. Sorry, I don't know of any mnemonic for these deductions.
