    This is what I have in my notes for Sec 179:

    -expense deduction in lieu of depreciation deduction for personal property (MACRS depreciation deduction)

    -limit 25K for new/used personal property acquired from unrelated party during the year

    -phase out $200K

    -deduction not allowed when a net loss exists or if the deduction would create a net loss

    -for SUVs, Section 179 limits the cost that may be expensed to $25K

    Does everyone have the same thing?

    How is your studying going, jfernandes? Since you would have to get a new NTS anyway, you might as well go for it. Are you using Ninja MCQ or another test bank? Ninja MCQ seems to grade hard.

    I'm using today to really nail professional responsibilities, 1933/1934 acts, and circ 230 since that's 15-19% of the test.

    I'm also a bit concerned about the Federal Tax Process (11-15%) since it doesn't seem like it's covered all that much in my review materials. I don't want to overlook that.

    all i know is 1933 = IPO's and 1934= secondary market, probably throw in a registration statement along with audited F/S

    @ Amay – For '33, you need to understand Reg D sections 504, 505 and 506. Which have to do with whether or not the securities need to be registered. I remember 505 as it relates to a total amount of $5M, 35 unaccredited investors with unlimited accredited investors. It'd also be a good idea to look at who doesn't have to register under '33.

    You also need to know about liabilities of the account under '33 vs '34. For 33′, the purchaser only (as it's an IPO) has the right to sue. They have to have been harmed by the accountant's work. However, reliance of the financial statements is not required and proving negligence is not required. The accountants defense is due diligence and followed GAAP (primarily).

    For '34, the account may be sued by purchasers or sellers. For liability to exist, again there need to be damages and material misstatements, but this time reliance on the statements must be shown. Additionally, the accountant acted with reckless disregard for the truth.

    I hope that helps a little.

    @Kimboroni Thanks for asking! It was a tough decision, but I decided to post pone my test date (still need to cancel my test). Based on the scores I was getting on the session results, the chances of passing were low. I have taken REG before so the thought of not passing again is something I don't want to experience.

    I am mainly using Ninja MCQ, however I do have Becker. There are topics in Ninja MCQ that Becker does not cover. Plus, I wanted to get familiar with the wording of the practice problems.

    Game plan: I am about half way through Ninja MCQ (751 problems). By this Thursday, I plan on finishing all the questions. Afterwards, I will review my notes, flashcards, and Blitz videos. Lastly, redo all the NINJA MCQ and Sims. If there is time, I will do practice a few exams. This should solidify my understanding of the concepts and allow me to be confident going into the exam.

    @Kimboroni – I thought the NINJA MCQ did a great job on the Tax Process stuff. It definitely looked more like what'd I seen on the exam in May. I really hammered those, as I remember coming across those and feeling completely unprepared last time.

    Well, I've just finished all the NINJA MCQs. I am taking a break after doing something like 700 questions since Friday. My test is Thursday, which has me more than a little stressed. However, taking a brain break is probably a good thing.

    Tomorrow, I'll start doing a few SIMS and review over my broader trouble areas. Thanks for all of you who are active here. This definitely encourages me when I'm feeling low about how long this process is taking.

    Any great thoughts on the final few days of preparation for this? Also, I know the NINJA MCQs haven't been out that long, but has anyone used just that and felt pretty good about test day? I know that Wiley didn't seem to get me quite there, and CPAExcel just took too long to get through things in the prescribed order. Plus, it really frustrated me that I couldn't take targeted test sections in study mode easily.

    @hollycontinues Based on other member's comments, people have been scoring generally higher on the real exam than their NINJA MCQs results.

    I would recommend doing several sims questions, write the NINJA notes (if you have them), and go over your weak areas to understand why you are getting them wrong.

    Just a curious question

    For liquidating distributions you recognize a gain to the extent “monies” exceeds basis, are marketable securities included in this “monies”

    I'm done studying for the weekend. I'm gonna study in the morning and at lunch tomorrow and then take it easy tomorrow night and get some rest. Test on Tuesday.

    @ jfernandes256 – Good suggestions! I just got my NINJA notes revision, so I'll take some time to re-write at least the sections I feel less strong on. My plan is do do some SIMS and some more MCQ over the next few days, as for some reason the MCQ are where I seem to bomb on the test. (I know, weird, but true as I'm usually great at MCQ as I've taken a lot of industry exams over the years for my job.)
