I am taking Jeff's challenge this weekend. I've done all the sims and the majority of the MCQs (have 80 that I haven't seen yet), so this will be the perfect opportunity to really drill into these topics. I've never done that many questions in a short amount of days, so this will require great discipline from me.

Any other REG candidates taking Jeff up on his offer?

I am doing the challenge! I am trying to get through all the B-Law questions on my first pass. There are 500+ of them in the Ninja MCQ. I've done 89 in the last 3 hours. This is going to be a challenge, but I'm stopping to take notes and look at the explanations so I don't think 89 in 3 hours is too bad. I only have until noon tomorrow to get them all done. Having access to the Blitz is my motivation. I have an hour long commute each way, so listening to audio on the way in, would be absolutely fantastic for me.

Question in Ninja MCQ:

Which of the following types of conduct renders a contract voidable?

A: Mutual mistakes as to facts forming the basis of the contract

B: Undue influence from a dominant party in a confidential relationship

C: Duress through physical compulsion

D. Duress through threats of civil lawsuit

The answer is C, but I thought it would be B because undue influence makes a contract VOIDABLE and extreme duress makes a contract VOID.

Anyone understand why the answer is C?

I had that same question earlier today and picked B as well. I wrote it down as something to come back to, because I thought I read in my book that undue influence is voidable. I'm going to look into it now and see what I come up with. I'll be back in a few minutes.

I just got another question that is similar, but the answer goes with what we thought above.

If a person is induced to enter into a contract by another person because of the close relationship between the parties, the contract may be voidable under which of the following defenses?

A. Fraud in inducement

B. Unconscionability

C. Undue Influence

D. Duress

The answer is C.

I don't know if the word “confidential” has something to do with why the other one would be wrong or not. I hope Jeff is readying and can chime in. I'm confused.

Several sources cited a restatement in contract law: Restatement, Second, Contracts §§174, 175. I am still confused though lol

A contract entered into under duress by physical compulsion is void. Also, if a party’s manifestation of assent to a contract is induced by an improper threat by the other party that leaves the victim no reasonable alternative, the contract is voidable by the victim. Restatement, Second, Contracts §§174, 175.
