MamabearMemberI must say that it is complete BS that the states have such relaxed guidelines on the criteria for filing a complaint against a CPA. Texas only requires a letter and it doesn't even have to be signed. That's ridiculous. I could just see people that have knowledge of this coming out of the woodworks to retaliate against old grudges, just because the person they have a grudge against is a CPA. It is really making me rethink how truthful I am on my employees' reviews this year. 🙁

LaComptableParticipantYes, to file a complaint is pretty easy. But, from reading the TSBPA complaints website, the complainant won't get very far if there is no evidence on which to base the claim. I would not let it impact your decision-making process as a manager. A disgruntled employee still has to provide evidence of misconduct for the complaint to go anywhere.
From the TSBPA website:
Q. Can I file a complaint anonymously?
A. Yes you can, but very few anonymous complaints can be successfully pursued unless the person making the complaint is willing to testify. The testimony of the person making the complaint is always important evidence. Also, we mail a copy of the complaint letter to the CPA to inform them of the exact nature of the complaint.
Q. What happens after I file a complaint?
A. Your complaint is reviewed by Enforcement Division staff, which determines whether the conduct described, if taken as true, involves professional misconduct. Not every dispute or disagreement with a CPA involves professional misconduct. Therefore, some complaints will be dismissed at this stage of the process.
Q. If the conduct I complained about alleges professional misconduct, what happens next?
A. An investigative file is opened. The CPA is notified of the investigation and is provided with copies of materials (excluding attorney-client communications and attorney work-product) and documents received as part of the complaint. The CPA has 30 days to respond to the Board in writing. After the CPA has responded to the allegations, the investigation is referred to one of the Board's Enforcement committees. These committees meet regularly to consider complaints. Pursuant to the Open Meetings Act, committee meetings are noticed in the Texas Register, but the meetings are not open to the public because investigative information is confidential by statute. The committee reviewing the complaint will make a recommendation on how to proceed with the investigation.

MamabearMemberWell that's a relief. I guess I should do my homework before I start making statements. When I read the explanation to the question in my Qbank, it didn't go into any detail about what happens AFTER the complaint is filed and I just sat here thinking…that's crap! Now I won't feel like the bullseye on a dart board when I get my license. On another note–doing much better on the business law stuff than I did on tax. If I had known how much overlap there was between AUD and REG I would have taken REG right after AUD. I still remember a lot of this stuff from studying for AUD, which is giving me a renewed sense of motivation and that is exactly what I needed today.

MamabearMemberYou could probably knock out the professional responsibilities MCQ right away if you just studied AUD. I don't actually believe it will be 15-19% of the exam, but it's great to get those easy points. I don't understand the posters who say REG and BEC have some overlap. If it exists, I'm not seeing it.

Tax ladyParticipantHi everyone! I sit for REG on 8/15 and I'm studying with CPAexcel. So far I'm in the Blaw sections and I'm really surprised at the amount of detail that is included. I feel like I'm over studying but I'm afraid if I don't learn it, then that's probably what will be on my exam! I'm so ready to get passed UCC. UGH

Tax ladyParticipant@copypaste Did you use CPAexcel for FAR? Is it even more long and drawn out since that is a larger section? I had no idea it was going to take me this long to get through the material…I've had to reschedule 2 times now!

MamabearMemberYou know what is refreshing about professional responsibilities? The questions are only a sentence long and easy to get through. Got through all 152 questions today. Scoring in the 70s on my first pass. So much better than tax. Not looking forward to going back to those long questions.

MamabearMember@CPA Title–I think you're doing really well! I have the business law section left to get through on a first pass in Ninja MCQ. I'm averaging in the 50s on my first pass of all the tax topics. 20 days for review is really good and you're scoring in the 70s on a first go through. Keep up the good work. You've got this!

AnonymousInactiveThanks mama, but I've been studying REG all year…..literally. I should be well out of the 70's by now. Was scoring mid 80's with the Wiley test bank right before REG attempt #2, only to come back with an actual score of 71. So, if I'm averaging low 70's in Ninja now, I'm absolutely frightened when thinking about my exam next month. I am so sick of studying taxes lol
