1 more thing – of the offer specifies that the acceptance must be received by a date in order for it to be valid is the exception to the mailbox rule.

@Yvonne: It seems complicated, but it's actually one of the easier law topics. In general, acceptances are effective went SENT, while offers, counteroffers, rejections, are effective when RECEIVED. It doesn't matter if the offer is lost as long as it was sent, so while the offeror may try and get out of it, the contract is valid and will be enforceable. The exception is if the offeror specifies (I must receive the acceptance by 3pm on 05/05/05, OR if they specify a method of acceptance) then it must meet those criteria. Otherwise, valid and enforceable. Work the problems and you'll see how they word things and it's a lot easier than it seems, I promise. Hope this helps!

Okay, re-reviewing and to be honest. I feel mentally retarded. It's not sinking into me. Perhaps because I'm challenged or because there has been too much stress going on at home. But what is simple to you, is very complicated and way over my head. The contracts/sales/law. I just am not getting it. I seem to understand when I listen to Tim G's lectures (Becker). Or maybe I need business law for dummies to accommodate my mental challenges. LOL.
