    According to Becker, when a spouse dies, you can file married filing jointly in year of death but according to Ninja Audio, you should file head of household and can file head of household for the next two years. Which is right?

    MFJ year of spouse death (Year 1)

    If you have a dependent living in your house the entire NEXT year you may use Qualifying Widower for that year (Year2). Same thing for the next year as well (Year 3)

    If your spouse dies and you do not have a qualifying dependent you are single the following year of death.

    My guess is that head of household would be okay if your spouse died and the dependent only lived with you for half the year.

    I agree with Dutkas…additionally, the best answer is what they are looking for. Mfj the year of death. Which will indicate the spousal death. They probably will list mfj, hoh, qwidow, or Mfs to throw you off. Remember the best answer.
