Can someone help me understand assignments a little better – I’m still a little bit confused in regards to when and who the assignee can sue. If the obligor is notified, then he will incur a liability if he pays the assignor instead of the assignee. If the assignee never gets the money and there is notification, can they sue both the assignee and the obligor? What if there was no notification, then who is liable in this case? Or do they have no rights to the money if there is no notification? Is a notification actually required to make an assignment effective?
Thanks!
