Tax Perparer for different states – registration in every state?

    I am not yet licensed as CPA in any state but applied for a PTIN. As far as I understand this only allows me to prepare Fed taxreturns. What about the state returns for the different states?

    For example for NYS I would have to register with the NY Dept separately to prepare state returns.

    Does anyone know which other states have the same requirement or where I can look it up?

    I believe NY does require you to register with the State but that is the only one I know of for sure. I have prepared in NC and NY was the only state I came across with that issue.

    There are some states that do require registration. Some, you need a special license if you are signing the returns prior to being a CPA.

    Some states require registration based on number of returns filed each year. I would look at each state you are going to file with and check their requirements. Some states will waive the registration requirement if you are registered with X state.

    Ok, as far as I could find out CA is the worst. They even want you to get a $5,000 surety bond to get registered as a paid preparer. But as far as I understand the exemptions this is not applicable to out of state filers. So in case I am a licensed cpa in FL I would not need to register to file CA tax returns.

    NYS also has an exemption for licensed CPAs, as well as FL and Oregon.

    I could not find any registration requirements for Delaware though …

    I might be wrong, but it seems like I remember hearing that DE doesn't have a state income tax? My parents live out there, so I should know, but they haven't been there real long. 😛 Seems like last year, though, they told me that they don't have income tax.

    I would assume, though, that if a state doesn't say anything about requiring registration, then it probably doesn't. I wouldn't just act on that assumption – maybe send an email to the taxing division or something like that to verify – but usually, if they have a requirement, I'd expect them to plaster it all over their website!

    That being said, just to add to the listing of states, here in KY there is no requirement for non-CPA tax preparers, and TN doesn't have an income tax (unless you have larger amounts of things like interest and dividends), so the TN clients I've worked with haven't required any form of registration either. If I had one that did have to file a TN return, I'd have to double-check on it, but I'm quite sure that non-CPA preparers still wouldn't need to register in any way.

    I have to file business tax returns and franchise tax returns in Delaware, not individual.

    I just thought there was a website or something that shows the requirements for all states. I have many clients who do business in different states or are incorporated in other states than Florida, so this is why it is getting pretty annoying to check all the states before I can file the tax returns as paid preparer. Everything should be easier when I get my cpa license.
