    In the hopes that I pass the exam tomorrow, I’m completing the paper work for NJ. There are two questions about being arrested and convicted of a crime. In 2008, I was picked up for public drunkeness and disorderly conduct. I believe one of the charges was dropped and the other I had to pay a fine for. I’m nervous to answer these questions with a YES. Anyone else had issues with these questions? How did you handle them?

    BEC - 77 - Passed (Becker)
    FAR - 79 - Passed (Becker)
    AUD - 73, 82 - Passed (Becker)
    REG - 67, 89 - PASSED (Becker + Ninja + Wiley Test Bank)

    Just wanted to toss my 2 cents in the ring on expungement.

    Expungement is not guaranteed by any means even if you retain a lawyer and go before a judge. While it might be nice if you could do this it would be really a bummer to pay $2,000 in attorney's fees and have nothing to show for it. I also will add that having spoken to an experienced attorney about issues such as this with digital records in counties and state bureaus of criminal apprehension it is much harder to make sure all the files are sealed. So in other words you may get the judgement you seek and still have your record searchable. Be very cautious using this approach.

    Criminal Records at Government Offices

    Many government offices keep criminal records, including, but not limited to:

    courts have records of all cases FILED with the court;

    police keep records of arrests and investigations;

    prosecutors have records of criminal cases;

    agencies like the Dept. of Human Services may keep records; and

    law enforcement agencies (police, State Patrol, etc.) send records to the MN Bureau of Criminal Apprehension (“BCA”)

    IMPORTANT!

    The BCA is a common place for people to do background checks. If your criminal case ended in a conviction, records kept by other government offices, such as the BCA, might not get sealed through an expungement action. Getting an expungement also might not help you from being disqualified to work as a caregiver by the MN Dept. of Human Serivces. You need to decide if the effort and cost of asking for an expungement will benefit you.
