Can someone clarify something for me on punitive damages:
I know under the common law, punitive damages are available for fraud.
However, on Becker pg. R5-44, when going through the Remedies for UCC (Sales), #3 states “Punitive damages are not available under the Sales Article”, BUT the instructor (Peter Olinto) as he is passing over this item states (and has a note displayed to the side) “Fraud only – not breach”.
So is he saying Fraud still classifies for punitive damages under the Sales Article…even though the book specifically says they are not??
