Who can approve NYS work experience?

    I am in the process of applying for my NYS license. My direct supervisor is license in PA. I was informed

    that the experience I must obtain needs to be from a CPA licensed in NY State. Does anyone know if that is true?

    This is in direct contradiction to the first paragraph of Form 4B that certified public accountant licensed in

    one of the U.S. jurisdictions can certify the experience.

    Also we have a consultant here who is familiar and supervise big part my work. She has NYS license. Can she approve my experience?

    Ҥ70.3 Experience requirements.

    An applicant who has satisfied the requirements as to education shall meet the experience requirement for licensure as a certified public accountant by submitting documentation, satisfactory to the Board of Regents, of completion of the following experience requirements:

    One year of acceptable full-time experience, or the equivalent thereof, shall be required for an applicant who has met the professional education requirements for licensure in section 70.2 of this Part through completion of a curriculum of at least 150 semester hours in a baccalaureate or higher degree program in accountancy, or its foreign equivalent, in accountancy that is registered by the Department pursuant to section 52.13 of this Title, accredited by an acceptable accrediting agency, or determined by the Department to be the substantial equivalent of a registered or accredited program.

    Two years of acceptable experience, or the equivalent thereof, shall be required for an applicant who has met the professional education requirements for licensure in section 70.1 of this Part through completion of a curriculum of at 120 semester hours in a baccalaureate or higher degree program in accountancy, or its foreign equivalent, that is registered by the Department pursuant to section 52.13 of this Title, accredited an acceptable accrediting agency, or determined by the Department to be the substantial equivalent of a registered or accredited program.

    For purposes of this subdivision, one year of full-time experience shall mean an aggregate total of twelve calendar months of full-time employment. Full-time shall be defined as a five-day work week, with at least 35 hours of experience per week, excluding overtime. The State Board for Public Accountancy may also credit an applicant for part-time experience in the amount of one week of experience for every two weeks of acceptable part-time experience earned. Part-time shall be defined as at least 20 hours of experience per week.

    Such experience shall be attested to by a certified public accountant licensed in New York or in another political subdivision of the United States or by a public accountant licensed in New York, provided that such certified public accountant or public accountant acted in a supervisory capacity to the applicant in the employing organization.

    Acceptable experience in the practice of public accountancy shall be limited to experience in providing accounting services or advice involving the use of accounting, attest, compilation, management advisory, financial advisory, tax or consulting skills under the supervision of a certified public accountant licensed in the United States or a public accountant licensed in New York.

    Acceptable experience in the practice of public accountancy shall be earned through employment in public practice, government, private industry or an educational institution.

    For purposes of subdivision (a), if the experience was earned more than ten years after the applicant passed the certified public accountant licensing examination, a license will not be issued until the applicant completes a satisfactory amount of continuing professional education, as is deemed appropriate by the State Board. “

    Certainly “under the supervision of a certified public accountant licensed in the United States or a public accountant licensed in New York.”

    or

    “Such experience shall be attested to by a certified public accountant licensed in New York or in another political subdivision of the United States”

    does not mean they must be licensed in New york.

    Seems pretty clear that it does not need to be an NY CPA. Considering the nature of the transferability of the exam and the clear regulations that make a note for this very situation – the PA CPA should be fine. Who told you this, exactly?

    I called NYS board Phone: 518-474-3817 ext 160, and I was told that a CPA licensed in PA can't approve work experience in NYS 🙁

    Argue with them and point them to that regulation. That is simply just not true. I am not an NY CPA or have dealt with it, but it is clearly allowed in the NYS Regulations.

    Unless PA Is no longer a state….which I'm pretty sure it is 🙂

    I definitely would be very stern on this point and point them exactly to the section/paragraph. The law is law, the guy's word on the phone is not the law.

    It looks like someone posted similar post last year. It is crazy how the board is ignoring the law. They need to make it clear if only a NYS CPA is allowed to approve the work experience. I heard a lot people were denied license in NYS because their supervisors were not licensed in NYS.

    Does anyone know, if a consultant, who is overseeing my work, can certify my experience? We have a NYS CPA who works as a consultant in our department, and he is familiar with work, and review big part of it.

    I'd get a lawyer and sue if I was denied and it was so clear in the law.

    Bad faith??? Would it be bad faith? I'm not a lawyer so I dunno, but bad faith = punies = cashhhhhh moneeeeeeeeeysssss~I think bad faith requires intent rather than just stupidity, though ><

    Man, I'm definitely not trying to be a jerk, but have a little faith in yourself. Check it out – the regulations are right there. You are a person that works in regulations!!!! It clearly says consulting skills, and it clearly says someone licensed in the USA, or someone licensed in New york.

    I don't see what the problem is. Call them on the phone, and if push comes to shove, threaten suit via the regulation, and get a lawyer to make a phone-call. Looks like a slam dunk. State that in the commissioners regulation 70.3 subsection A paragraph 4 it clearly says you are correct, and further it says that in subsection B.

    I doubt the guy on the phone is a CPA, and if he refuses, ask to talk to someone smarter than him. And say it that way.

    Just flex your regulation muscles a little.

    hey davliu,

    I had the same question that you had so I emailed the NYS board at cpabd@mail.nysed.gov asking if my experience had to be certified by a CPA also licensed in New York and I received this response:

    “No, if you plan on getting your CPA license in New York, your supervision does not have to be in New York State or with a New York CPA. You can gain experience in other states from other CPA's licensed in other states. You may also gain international experience provided that the CPA supervising you is a USA CPA that is licensed and registered.”

    hmm, I e-mailed the same e-mail address and i got the response below:

    “The Supervisor that is certifying your experience needs to be Licensed and currently registered in the State your experience is taking place. “

    Vlakmir, I just finished all 4 parts and no energy to fight any more :), but i guess i will have to if needed.

    I am not sure if different people on the board interpret things differently.

    I had the consultant fill out a new application for me so I will send it to avoid the headache. but what if someone has no one else to sign the form for him/her.

    Somehow others got their license after bringing up the same issue. Try research old forum posts. Good luck

    @davliu, yes my work is in NYS, although I have not submitted Form 4B yet as I have not met the 1 year of experience requirement.

    Well, at least take solace that you have the truth on your side. I can say without any feeling of doubt that you will be okay – it just might take someone past the guy answering the e-mail/phone to get a result. People make mistakes, but the letter of the law is unchanged. I'm sure the board has people like this all the time.

    You're about to be licensed to give your opinion on regulations, but you are having trouble feeling comfortable reading and believing regulations regulating the regulating process…! You're not a noob anymore!!! <3. BELIEEEEV(b)EEEE!

    I am going to go through a similar process.

    I actually kinda just freaked out about California's new ethics requirements, until I saw what topics were included under ethics. Took a while but I've definitely had my “OMG I DID ALL THIS WORK AND NOW IT'S NOT GONNA WORK OUT?!” moments.
