    Hi CPAs

    I have an client who is having ITIN and using another person’s SSN to work and get W2. I wonder If I am able to prepare his tax return with ITIN but fake SSN in W2 entry. I have searched IRS website and IRS does not restrict on filing tax return with ITIN and fake SSN on W2. However, I am considering about the ethic and would like to get the advice from experienced CPAs who were dealing with this situation.

    Fire that client immediately.

    If you HAVE to do this return, I would suggest you paperfile using the ITIN on the return, but attaching a copy of the W2 with an explanatory letter on your letterhead explaining the wages and taxes withheld belong to that ITIN but were incorrectly reported under someone else's SSN.

    But seriously. That guy or girl is a total dick. Imagine being the poor schmuck with that SSN and your return and refund gets flagged every single year because some jackass is using your identity and you are getting flagged with additional W2 income. Fire the client and walk away.

    If your state does not require an ethics exam I would suggest you take a couple classes. I'm really not sure why you're even considering this.

    For real? I think the “fake SSN on W2” is the giveaway here. THAT is restricted.

    Agree with Bourne. Maybe an ethics course would do you good.

    Um, it says right there that a SSN is not required:

    Do I need an ITIN?
    Does the following apply to you?
    You do not have an SSN and are not eligible to obtain one, and
    You have a requirement to furnish a federal tax identification number or file a federal tax return

    Oh man, they are going to eat you alive. FAKE is never good. To use someone else's ssn# is identity theft. You should not do that return at all. Do not put your name on any of that. FAKE IS BAD NEWS. What else are they lying about? 🙁

    The reason I ask because he has filed his tax for couple years without any caught from IRS. I was so surprised of the previous preparer did that without any problem. I have rejected the return, and I want to share this scenario for further discussion.
