OT: How to protect my license - Page 4

    I am currently seeking a new job, this is not likely to be a long time situation but I can not be unemployed.

    I do not SERIOUSLY believe my cpa license would be in jeopardy but not taking any chances.

    My boss wants to give all of the employees gift cards as awards/bonus. I told him that the IRS is clear that gift cards (of ANY value, even $10) must be added to the employee’s taxable income. He (not a CPA) demanded that I give out the gift cards and not add them to ADP.

    I asked him to please put that order in writing, as I have a CPA license to protect and will not jeopardize it over a stupid $50 amex gift card. He has refused. In fact he raised his voice and told me he will NOT let me hold MY CPA license over HIS head.

    Again, even if the IRS caught this minimal infringement, HE would be responsible for the penalties and fines if any. I don’t sign off on any of this. Just fries my backside that he would HIRE a CPA and not take the advice of the professional he chose.

    Off to search monster.com………….again.

    @mla Just to clarify, are the bonuses officially from the company or from him?

    And just a thought to throw out there, though I haven't researched the law regarding this specifically…. If he gives them out and it's officially from him personally, are you clear? And, if he signs off on the W-2's (or crap, what's it called, W-3?) when it's mailed to the SSA, are you still clear?

    I debated some similar questions with a former employer and blatant disobeying of IRS laws, but thankfully it was before I was a CPA. I'm hoping that having been aware of these issues before being a CPA can't be a problem if he's fried after I'm a CPA. But anyway, I understand the frustration of having to be a bystander – showing the IRS laws and getting the “Well that doesn't matter here” or “Well I'm not worried about it” response. 😐

    Theyre from the company, not him personally. I had suggested him purchasing himself but he is adament that he wants them deductible. Fortunately I decided to ignore him, go to the employees and explain the company wants to give a bonus but they need to pick a gift of said dollar amount, they were beyond thriled, I ordered everything yesterday and told my boss he could personally hand out the gifts. Seems to have forgotten his stance and thanked me for picking up HR's job…..again. of course she just slides because shes young and hot 😉

    Next time, take the total of the gift cards and add it to MR. KNOWITALL's taxable income.

    @mla1169 That sounds like a great resolution! Now you can keep your license and your job long enough to find a new job. 😉 Honestly having the employees pick out a gift works better than buying something random anyway – I'm sure they really appreciate this Christmas! (Also in some ways works better than cash or cash equivalents, since this way, they get something they want instead of using it to buy diapers…)
