OT: How to protect my license - Page 3

    I am currently seeking a new job, this is not likely to be a long time situation but I can not be unemployed.

    I do not SERIOUSLY believe my cpa license would be in jeopardy but not taking any chances.

    My boss wants to give all of the employees gift cards as awards/bonus. I told him that the IRS is clear that gift cards (of ANY value, even $10) must be added to the employee’s taxable income. He (not a CPA) demanded that I give out the gift cards and not add them to ADP.

    I asked him to please put that order in writing, as I have a CPA license to protect and will not jeopardize it over a stupid $50 amex gift card. He has refused. In fact he raised his voice and told me he will NOT let me hold MY CPA license over HIS head.

    Again, even if the IRS caught this minimal infringement, HE would be responsible for the penalties and fines if any. I don’t sign off on any of this. Just fries my backside that he would HIRE a CPA and not take the advice of the professional he chose.

    Off to search monster.com………….again.

    Hahaha. Kricket, you are right! Sounds like he hires at least 2 CPA and bunch of the people and he is a sole proprietor?! Should be an LLC.

    I spoke to an ancient wise man who sent me on a mushroom induced journey through an ancient forest to find the key to passing the CPA exam. A talking spider monkey told me to throw the last of my drinking water in the dirt to find what I was looking for. So I followed his instructions and the following message appeared in the soil:

    No, its an S-Corp. Then he's got the holding corp and the business trust under the same umbrella. only one CPA (me) and a person who does the A/P and A/R for me.

    Having been on the other side of the desk I can see his point of view, and why he does not respect you. I will not explain it here for fear of inciting a riot (heated debate would be too mild 🙂

    If you would consider some advice:

    Schedule a meeting with him to make it sound serious and important. Prepare with notes, maybe even a powerpoint. Then present this argument:

    “Mr. Boss, I understand you hired me because I am a CPA. I imagine you did so because you thought a CPA could help your company succeed, etc. Well, I can and I do help your company succeed. I can save you money in variety of ways (list them), including tax savings (list them, and actually do research in this area).

    On the other hand it means playing by the rules and not cutting corners or petty cheating. This is like penny wise, pound foolish. I can save you pounds playing by the rules, or you can save pennies by cheating. You can see the advantage of saving pounds.”

    Show him how is wrong by showing him how you can save him money. Stay focused on that, and only that.

    Talk with his tax CPA about tax-saving programs (manufacturing credits/ R&D credits, hiring credits, etc), and make regular presentations to show your research. Even if the company does not yet have such programs, he will appreciate your input and show him that you are on his side (the company's side).

    MOD it's been quite a while since I decided to dismiss your feedback entirely. Most of what you contribute here is beyond ridiculous and to date very little if any of it has to do with CPA exams (go figure, on a CPA message board?)

    Your first two sentences above confirm what I've known all along about you. While I think it's cute that you consider yourself so “seasoned” professionally, your people skills are entirely absent. As for your “advice” above, I appreciate the laugh. I've been an accounting professional for many years and I know well how to excel in said position which is why I have such long tenures at my previous jobs and why all would rehire me if a similar position were open. Don't flatter yourself by thinking you know something I don't. The question is how to protect my license in this situstion-do work on your reading comprehension. It will serve you well on the exam .

    As for my boss and his “reasons” for not respecting me- well he had to settle on a discrimination lawsuit recently. I am assured I have a legal case as well if I chose to pursue that route. Initially I didn't want to but if I continue to see a trend of harrassment against older women like myself I will do so for their sake. Make no mistake I have nearly two years of documentation.

    @mla Just to clarify, are the bonuses officially from the company or from him?

    And just a thought to throw out there, though I haven't researched the law regarding this specifically…. If he gives them out and it's officially from him personally, are you clear? And, if he signs off on the W-2's (or crap, what's it called, W-3?) when it's mailed to the SSA, are you still clear?

    I debated some similar questions with a former employer and blatant disobeying of IRS laws, but thankfully it was before I was a CPA. I'm hoping that having been aware of these issues before being a CPA can't be a problem if he's fried after I'm a CPA. But anyway, I understand the frustration of having to be a bystander – showing the IRS laws and getting the “Well that doesn't matter here” or “Well I'm not worried about it” response. 😐
